MICHAEL W. DEBRE concentrates his practice in commercial litigation. He is a member of the Chicago Bar Association.

Prior to joining Askounis & Darcy, Mr. Debre worked for seven years at a commercial bank in Chicago where he held various lending and management positions. During that time, Mr. Debre gained broad experience in the documentation of secured transactions, including loans for real estate acquisition and construction, and loans secured by equipment, vehicles, accounts receivable and other assets. Mr. Debre managed a $60 million highly-diversified loan portfolio and also coordinated the bank�s collection efforts, which included foreclosures, confessions of judgment and other breach of contract claims. Having had the unique perspective of overseeing a lending institution, Mr. Debre understands the challenges facing creditors during the debt structuring process and also when borrowers default on obligations.

Litigation

Askounis & Darcy, PC litigates nationwide in state and federal courts, pursuing commercial claims for: breach of equipment leases and loan agreements; mortgage fraud; fraudulent conveyances; insurance claims related to damaged or stolen collateral; and replevin. We also defend a wide range of commercial claims, ranging from breach of warranty and bankruptcy preferences to alleged violations of the Consumer Fraud and Deceptive Practices Act and lack of good faith. Our clients rely on our expertise in asset-based lending and leasing to manage their commercial litigation portfolios regionally and nationally. Our attorneys have appeared in the state and federal courts of nearly all fifty states. We also have developed a nationwide network of local counsel to aid us in states where our attorneys are not licensed to practice and to reduce our clients� expenses.

Bankruptcy

Our lawyers devote themselves to guiding creditor clients through the complex issues involved in protecting their rights and collateral when debtors reorganize or liquidate their businesses, including plan objections, dismissals for bad faith filings, motions to modify stay and to allow administrative claims, as well as defending preference and other adversary claims. We are also experienced in protecting creditors� rights in assignments for the benefit of creditors.

Collections

We are able to manage a large volume of commercial collection work, using our experienced staff to move cases forward and to negotiate settlements. We perform thorough post-judgment collection activities, from wage garnishments to foreclosing on judgment liens on real estate, to pursuing fraudulent conveyances and asset seizures. We offer a range of billing choices, including contingent fees, to help our clients manage their litigation expense.

Governmental Investigations

Askounis & Darcy, PC has defended its clients in some of the most high-profile governmental investigations of the leasing industry in recent years, most notably from claims and subpoenas filed or threatened by twenty-seven attorneys general and the Federal Trade Commission in the NorVergence matter, as well as cases relating to alleged Stark Act violations. See F.T.C. v. IFC Credit Corp., 543 F.Supp.2d 925 (N.D. Ill. 2008) (dismissing count of complaint accusing leasing company of employing an �unfair� practice by enforcing equipment lease�s floating forum selection clause).

THOMAS V. ASKOUNIS has over 35 years experience representing financial institutions, national and regional banks, independent and captive leasing companies, mortgage lenders and financial services companies in bankruptcy/workouts and transactional matters.

His transactional experience negotiating and documenting equipment finance transactions involving construction, printing, rolling stock, medical and computer equipment includes asset based loans, real estate collateralized transactions and the purchase and sale of lease and loan portfolios.

While initially gaining experience representing Chapter 11 debtors and serving as counsel to the Trustee for the Rock Island Railroad, Mr. Askounis� bankruptcy practice today is exclusively limited to creditor representation on a local and national basis. Mr. Askounis� experience includes participation on Chapter 11 creditors committees, structuring workouts, pursuing fraudulent transfers and defending secured creditor clients from claims in bankruptcy. Representative cases include Kmart, Chicago Tribune, Chrysler and General Motors.

As an active participant in the equipment leasing industry, Mr. Askounis currently serves as a member of the Board of Directors and the Service Providers Business Council for the Equipment Leasing and Financing Association (�ELFA�). Mr. Askounis previously served on ELFA�s Legal, Banking, Municipal Law, Membership and Credit and Collections committees. He has guest lectured at the Legal Forum, the Credit and Collections Conference and the Funding Symposium sponsored by ELFA. A current member of the American Bankruptcy Institute, he is also a member of the Commercial Bankruptcy Committee of the Commercial Law League of America. Mr. Askounis chaired the Legal Committee and served as a past board member for the United Association of Equipment Lessors. He previously served as President of the Hellenic Bar Association and is currently a member of the Leasing Subcommittee of the American Bar Association.

Mr. Askounis is rated AV by Martindale and the recipient of the Illinois Super Lawyers Award annually since 2005.
